C O N T R A C T
FOR THE MAINTAINANCE AND SECURITY OF THE REAL ESTATE

    1. GENERAL CONDITIONS




  1. The PRINCIPAL is the owner of apartment..............................., located in complex Vista Del Mar Sunny Beach-Saint Vlas, Bulgaria, called in brief “Real estate”.




  1. The EXECUTOR is the management party of holiday complex Vista Del Mar, Ravda resort, Bulgaria, and as such provides the needed equipment, human resources and experience, necessary for the carrying out of the maintenance and security of the holiday complex as a whole.



  1. The PRINCIPAL wishes to use the options for the maintenance by the EXECUTOR indicated in the previous paragraph, through his nomination as manager of his own real estate.




    1. SUBJECT OF THE AGREEMENT




  1. The PRINCIPAL makes the assignment and the EXECUTOR accepts to maintain and guard the property against payment with regard to the conditions described in items 5 and 6.

  2. The EXECUTOR will perform their obligations in accordance with this contract by means of personnel appointed by them and by assigning them to another juridical person.
    1. RIGHTS AND OBLIGATIONS OF THE PARTIES





  1. The EXECUTOR is obliged to provide the following services:




  1. to provide a 24-hour guard of the real estate by a specialized company for the security and protection of the site through assembling and management of the special and security equipment.

  2. to carry out the maintenance of the hygiene of the real estate that includes a regular cleaning of the shared areas of the building and maintaining in good condition of the illumination in the shared areas as well as a current maintenance and repairs of installations and appliances in the shared areas. All other additional services and maintenance will be paid additionally over an agreement between the parties.

  3. to provide maintenance and care for the green areas and the planning around the building in which the property is, as well as a regular cleaning of the pool.

  4. in case of urgent need to carry out immediate actions at the expense of the PRINCIPAL in order to avert, limit and/or remove damages in case of:

  1. nature disasters;

  2. fire;

  3. failures of appliances and installations in the real estate or in a neighboring property;

  4. other bad whether abnormalities, damages or dangers for the real estate;

  1. current maintenance and repairs of the installations in the real estate;

  2. carrying out of current and main repairs of the real estate over an agreement with the PRINCIPAL and at his expense, excluded from the money reward in this agreement;

4.When performing their obligations over this agreement, the EXECUTOR is obliged to take the necessary care for the interest of the PRINCIAPL as well as to inform them about all violations and other emergency circumstances causing damages or risks for damages of the real estate.

5.The PRINCIPAL is obliged to:



  1. to pay the EXECUTOR the agreed money reward in this contract within the terms and in the ways indicated in articles 6 and 7 of this contract;

  2. to inform in writing the EXECUTOR in case of changing the ownership of the property or letting it out to third parties;

  3. when needed, to give the EXECUTOR information and to cooperate if necessary for the accomplishment of the obligations in this contract.


III. MONEY REWARD. WAY OF PAYMENT

6.For the services provided in this contract, the PRINCIPAL pays a money reward in the amount of 8 EUR /eight euro/ with VAT per square meter of the total built-up area of the properties,specified in enclosure No 1 of this contract, payable as follows: annually, but not later than 30th March /thirtieth of March/ in the current year. The payment for the present year will be made at the transfer of the ownership of the property and the obligations over this contract will be described in the notary deed at the transferring.

7.The amount according to article 6 is to be paid in cash or by bank to the account specified by the EXECUTOR.


IV. TERM. TERMINATION OF THE CONTRACT

8.The present contract is valid for the next 2 /two/ years.

9.The contract will be not terminated in case of change of the ownership over the property.

10.In case of failure to fulfill the obligations in this contract, the trouble-free party has the right to terminate unilaterally the contract with a one-month written notification.

11.In the cases described in article 10 the trouble-free party has the right for compensation for the damages suffered due to the non-completion.

The present contract was composed and signed in two identical copies – one for each party.



For questions that are not settled in the present contract, the regulations of the Bulgarian law shall be applied.
