b) three years from the date of occurrence of the circumstances under Art. 54, para. 1, p. 5 letter "a", and so on. 6 and Art. 55, para. 1, p. 2-5, unless the act that established the fact is given another term



4.8.In accordance with Art. 56 para. 1 of PPL participant to whom there are grounds under Art. 54, para. 1 and indicated by the Contracting Authority circumstances under Art. 55, para. 1 shall be entitled to present evidence that he has taken measures to ensure its reliability despite the presence of the respective grounds for removal

For the above purpose participant can demonstrate that:



  • repaid its obligations under Art. 54, para. 1, p. 3, including accrued interest and / or penalties or that they are rescheduled or secured;

  • has paid or is in the process of payment of due compensation for all damages incurred as a result of the offense or infringement;

  • exhaustively clarified the facts and circumstances, actively cooperated with the competent authorities and to fulfill specific prescriptions, technical, organizational and staffing measures by which to prevent new crimes or violations.

According to Art. 45, para. 2 IRPPL as evidence of the reliability of the participants following documents:



  • regarding the circumstances under Art. 56 para. 1 pt. 1 and 2 PPL - proof of payment or agreement or other document from which it is clear that the obligations are secured or that the parties have negotiated their deferring or rescheduling, along with a repayment plan and / or set dates final payment due obligations or is in the process of payment of compensation payable;

  • regarding the circumstances under Art. 56 para. 1 pt. 3 PPL - a document from the competent authority to confirm the circumstances described.

According to Art. 45, para. 1 IRPPL when for a participant is available one of the grounds under Art. 54, para. 1 PPA and before the filing of the offer it has taken measures to prove the reliability of art. 56 PPL these measures are described in the filed by the tenderer unitary European single procurement document (ESPD).

The Contracting Authority shall consider measures taken by the participant, taking into account the severity and the circumstances related to the crime or offense. If the measures taken by the participant are sufficient to ensure its reliability, the Contracting Authority will not reject it from the procedure.
The reasons for acceptance or rejection of the undertaken under Art. 56, paragraph 1 of PPL measures and the evidences are indicated in the Decision for ranking or termination of the procedure, depending on the type and stage in which the procedure is.

4.9. Except on the grounds of Art. 54 of the PPL, the Contracting Authority eliminates from the process:



  • participant to whom there are grounds for prohibition under the economic and financial relations with companies registered in jurisdictions with preferential tax regime related persons and their beneficial owners and are not the exceptions provided for in the PPL;

  • participant who does not meet the set selection criteria or does not fulfill other conditions specified in the contract notice (Art. 107 par. 1 pt. 1 of the PPL);

  • participant who has submitted an offer which does not comply with: (i) the previously announced terms of the contract and / or (ii) rules and requirements relating to environmental, social and labor law, applicable collective agreements and / or regulations international environmental, social and labor law, which are listed in Appendix № 10 to Art. 115 PPL (art. 107, para. 1, p. 2 PPL);

  • participant who has not submitted within the rationale of Art. 72, paragraph 1 or whose offer is not accepted pursuant to Art. 72, para. 3-5 PPL (art. 107, para. 1, p. 3 PPL);

  • participants who are affiliates within the meaning of paragraph 2 pt. 45 of the Additional Provisions of the Public Procurement Low (art. 107, para. 1, p. 4 of the PPL).

According to Art. 57, paragraph 2 of the PPL the rules for rejection are applied when the participant is a consortium of individuals and/or legal entities and for a member of the consortium is available one of the grounds for removal.

When the participant intends to use subcontractors or rely on the capacity of third parties in respect of the selection criteria, it must certify that regardingto the subcontractors and third parties are not available grounds for rejection from the tender procedure.
5. “Buyer’s profile”

The Contracting Authority supports "buyer profile"



http://pudoos.bg/?p=14087, which is a distinct part of the website of the EMEPAhttp://pudoos.bg, and which is provided publicity and full application in accordance with the provisions of the Public Procurement Act.

From the date of publication of the decision and announcement in the Public Procurement Register (PPR), the Contracting Authority - EMEPA published no later than the next business day at the buyer profile the tender documentation (dossier) for participation in the procedure and provides a full free access electronically to her Internet address: http://pudoos.bg/, section "Buyer’sprofile". Those who wish to receive it, can have it by download from the official website of the EMEPA, Section "Buyer’sprofile".


The documentation for participation is completely free of charge!

On the mentioned internet address: http://pudoos.bg/ - Buyer’sprofile in the dossier of the tender, the Contracting Authority will publish also written explanations and answers to any queries received. The answers of the questions are published on the buyer’s profile in 4 days of receiving the request.


6.Requests for clarification or additional information can be made up to 7 (seven) calendar days before the deadline for receipt of tenders by any person - in person or by a person with power of attorney or by explicitly authorized another person in one of the permissible methods, fax number: 02 980-41-31, by post or courier to the address of the Contracting Authority. Clarifications, additional information or supporting documents shall be sent or delivered by the Company of all persons who received tender documentation and provided an address for correspondence incl. by e-mail or fax in 4 (four) days of receiving the request and apply to the documentation to be obtained from other interested parties. In the clarifications, additional information and supporting documents do not specify the person who requested.
7. General instructions - interpretations

When an interested party has requested, the Contracting Authority shall provide:



  • clarification or additional information concerning the documentation to conduct the procedure and technical requirements;

  • requested additional documents in its possession and which are not classified information

All costs associated with participation in the open procedure for procurement, including costs related to research and the discovery of the site are fully borne by the interested parties, respectively the participants.


Pending the outcome of the tender it is not allowed exchange of information on issues related to its conduct except as specified in the PPL and in the documentation between the interested parties, tenderers or their representatives:

a) authorities and officials of the EMEPA related to the implementation of the tender;

b) authorities, officials, consultants and experts involved in the drafting and adoption of the tender documentation.
Authorities, officials, consultants and experts involved in conducting the tender may not disclose information about their activities on or in connection with the open tender, except in cases and under specified documentation;

The Contracting Authority shall inform any person who has purchased the documentation accordingly each participant for any decision relating to its participation in the procedure;



  • All communications and actions between the Contracting Authority and the actors associated with this procedure in the process of selecting a Contractor in writing and only Bulgarian language. Letters / correspondence presented in a foreign language must be submitted translated in Bulgarian language.

  • The exchange of information between the Contracting Authority and the participant can be done one of the following acceptable ways:

a) personally - against signature;

b) by post - by registered letter with acknowledgment of receipt sent to that address by the participant;

c) by courier service;

d) by fax;

e) electronically - by email. If upon notification by e-mail (incl. And so indicated on the official website of the participants), the time of receipt by the participant / interested party / artist will be considered from the date of received at Principal confirmation by an interested party / actor / performer received by the Principal alerts / notification;

f) a combination of these means.


The letters and notifications should be addressed to that for this purpose a contact person.


In case of change in the specified address and fax correspondence, those participants are required within three (3) calendar days, duly notify the Contracting Authority;

Incorrectly specified address or fax correspondence or notification of change of address or fax correspondence released Contracting Authority of liability for inaccurate sending notices or information;


Exchange and storage of information in the course of conducting the procedure for public procurement is carried out in a manner that ensures the integrity, authenticity and confidentiality of information;

7.1. When submitting an offer the tenderer may indicate in it, by Declaration on own template which part of the offer in accordance with Art. 102 of the PPL, has confidential character and require the Contracting Authority not to disclose it. Participants may not invoke the confidentiality of the proposals of their tenders, to be assessed (art. 102 par. 2 of the PPL)


7.2. With the act of presentation of offer shall be deemed that each tenderer declares that he agrees and unconditionally accepts the stated in the documentation for participation in the tender procedure conditions and guidelines for participation in the tender as well as technical specifications and draft contract
8. Inspections on site

Visit the exact location of the site for construction of the facility, subject to specific differentiated positioning is organized by representatives of the municipality, as follows:



Each working day during the hours of 10:00 to 16:00 any interested person shall give prior written notice to the EMEPA, stating the date on which there is the opportunity to visit sites and UIC / BULSTAT. The notification shall be sent not later than three (3) days prior to conducting the inspection. Individuals should carry an ID card. The visit is carried out by the legal representative of the participant personally or by duly and expressly authorized to inspect representative with power of attorney. For committed visit is drawn up, signed by a representative of the EMEPA or a particular municipality on the one hand and on the other hand - the person the official representative of the person concerned said visit. To his offer each participant a declaration of spot inspection and familiarization with the conditions of the construction site (Template № 8)


Participant/ interested person may perform a view to building sites without use of the above procedure, but for this purpose it need to certify that fact in its offer by applying the Declaration of familiarity with the conditions of the construction site (Template№ 9).

Tenderer who has not committed a visit and inspection of the construction/s object/s will be removed from further participation in the procedure, but unfamiliar with the place, conditions of performance and characteristics of the construction sites is a risk in the preparation of the technical and bid execution of a specific lot.


ІII. OFFER

1. Preparation of the offer

  • The Offer may not be sent in options.

  • It is the sole responsibility of the participants for proper understanding of the terms of the notice and tender documentation.

  • Tenderers must study all instructions and conditions for participation set out in the tender documentation;

  • When preparing to offer each tenderer must adhere exactly to the announced conditions by the Contracting authority;

  • The presentation of the offer obliges tenderers to fully accept all terms and conditions mentioned in this documentation, subject to the PPL;

  • By the deadline for submission of offers each tenderer may modify, add or withdraw itsoffer;

  • Each tendererin the procedure may submit only one offer;

  • A person who is involved as a subcontractor in the offer of another participant, may not submit a separate offer;

  • The templates in the tender documentation and conditions described therein are obligatoryfor the tenderers. The tenderers should fully comply with these templates;

  • The offer shall be signed by the person representing the participant or by a duly authorized person or persons in the offer applies attorney from for representing the company.

2. Packaging and submission/ acceptance of the offer
Documents relating to participation in the procedure shall be submitted by the applicant or participant or by his authorized representative - in person or by postal or other courier service by registered mail with return receipt to the address specified by the Contracting Authority.
Documents shall be submitted in a sealed non-transparent "packaging" (General envelope) on which the following information is indicated:

  • the name of the tenderer, including participants in the consortium, if applicable;

  • mail address, telephone number and if possible - fax and email;

  • the name of the tender, for which the offer is sent, stating the lots to which they participate.

The pack includes documents of art. 39, para. 2 and par. 3 pt. 1 of IRPPL, an inventory of the documents, and a separate sealed opaque envelope marked "Proposed financial parameters" that contains a bid on art. 39, para. 3 pt. 2 of IRPPL. If the tenderer participates for more than one lot in the package are placed individually complete documents under Art. 39, para. 3 p. 1 IRPPL and separate opaque envelope marked "Proposed price parameters", indicating the position to which they relate


For offers received at Contracting Authority a register is kept, which notes:


Upon receipt of the offer on the packaging of art. 47, para. 2 IRPPL, are indicated the serial number, the date and time of receipt and the carrier will receive a relevant document.


Offers that are submitted after the deadline for receipt or in a broken or unsealed package will not be accepted.
If tt the time of the deadline for receipt of offers at the respective place for their submission, there are still people waiting, they will be included on a list which will be signed by a representative of the Contracting authority and the persons present. The offers of the tenderers in the list are entered in the above register. Not allowed receipt of tenders by persons who are not included in the list.
Received offers will be submitted to the Chairperson of the Evaluation Committee and a relevant Protocol is prepared with the data of the tenderers. The Protocol shall be signed by the sender and the Chairperson of the Evaluation Committee.
In the overall envelope (package) of the offer must be indicated:

  • Contracting authority - Enterprise for Management of Environmental Protection Activities (EMEPA), 4"Triadica" str.,. Sofia

  • The name of the tenderer, including participants in the Consortium, if applicable;

  • Address for correspondence, telephone number and if possible - fax and email address of the participant;

  • Name of the tender: "............ thename of tender and Lot/s for which participates the tenderer are indicated ............".
