MARITIME LABOUR CONVENTION 2006
Declaration of Maritime Labour Compliance – Part I
(Note: This Declaration must be attached to the ship’s Maritime Labour Certificate)

Issued under the authority of the Government of the Republic of Bulgaria

by The Maritime Administration of Bulgaria
With respect to the provisions of the Maritime Labour Convention, 2006, the following

referenced ship:

The undersigned declares, on behalf of the abovementioned competent authority, that:


  1. the provisions of the Maritime Labour Convention are fully embodied in the national requirements referred to below;

  2. these national requirements are contained in the national provisions referenced below; explanations concerning the content of those provisions are provided where necessary;

  3. the details of any substantial equivalencies under Article VI, paragraphs 3 and 4, are provided (strike out the statement which is not applicable);

  4. any exemptions granted by the competent authority in accordance with Title 3 are clearly indicated in the section provided for this purpose below; and

  5. any ship-type specific requirements under national legislation are also referenced under the requirements concerned.




1. Minimum age (Regulation 1.1)


Ordinance for labour and directly connected relations between the members of a crew of a ship and a shipowner, dated 14.10.2003

Chapter 2 – Work relations, Section 1, Article 4, Paragraphs 1 and 2 - Minimum age requirement for employment on a ship is 18 years. Young persons under and between 16 and 18 years old are allowed to carry out on board training.

Persons under the age of 18 are not allowed to carry out training during night hours, unless when the training program requires the fulfilment of their duties during night hours and there is no threat to their health. Night work shall be work performed between 10.00 p.m. and 6.00 a.m. (Article 27)








2. Medical certification

(Regulation 1.2)



Merchant Shipping Code (Last amended SG 28/2013)

Chapter 5 – Articles 87 (4) - requires all seafarers to pass medical examination in accordance with Ordinance of Minister of Transport and Minister of Public Health

Draft of the Ordinance on medical fitness of the seafarers – stipulates standards for medical fitness based on ILO/WHO Guidelines for conducting pre-sea and periodic medical fitness examination for seafarers, maximum period of validity of certificate shall be two years for persons between 18 and 60 years.

Ordinance No. 6/ 05.04.2012 for the competency of seafarers in the Republic of Bulgaria

Chapter 3 – Medical fitness

Articles 12 – Every crew member of a ship flying Bulgarian flag or candidate for certification shall meet the medical fitness standards for service in the relevant capacity.



3. Qualifications of seafarers (Regulation 1.3)

Chapter 5 – Articles 87 and 88 – the different employment positions of seafarers require different qualifications, attested by certificate of competency issued by the Executive Agency Maritime Administration.
Ordinance No. 6/ 05.04.2012 for the competency of seafarers in the Republic of Bulgaria stipulates the requirements for the certification of seafarers

Chapter 4 Requirements for acquisition of a competency for serving on board seagoing ships, Articles 36-47 – covers the education, training, registration and certification of seafarers as it is required by STCW Convention.





4. Seafarers’ employment agreements

(Regulation 2.1)



Merchant Shipping Code (Last amended SG 28/2013 )

Chapter 5 – Article 88b – the employment agreements of seafarers are to be made according to the requirements for health and safety working and living conditions and healthy working environment.
Ordinance of labour and directly connected relations between the members of a crew of a ship and the shipowner and draft for amendment:

Chapter 2 - Work relations, Articles 4-8 – requires that all seafarers should have an employment agreement and information which have to br included.




5. Use of any licensed or certified or regulated private recruitment and

placement service (Regulation 1.4)




Ordinance concerning the conditions and organisation of the conducting of mediation activities in recruitment

Chapter 4 – Mediation activities for the recruitment of seafarers.

Article 34 - the mediation activities for the recruitment of seafarers is conducted in accordance to the requirements and provisions laid down in the conventions of the International Labour Organisation and the International Maritime Organisation, which conventions are ratified and implemented into the national legislation of the Republic of Bulgaria.



Article 35 – sets the requirement that the agent have to registers all mediated contracts between seafarers and shipowners into the Employment Agency.

Articles 36, 37 and 38 – concerning the duties of the agent.

6. Hours of work or rest (Regulation 2.3)

Ordinance of labour and directly connected relations between the members of a crew of a ship and the shipowner:

Chapter 3: Hours of work and rest

Articles 16 - 23 – set the working hours and hours of rest for all seafarers in accordance to the MLC.

Articles 24 - 28 – set the rules for the working of seafarers for extra hours or during night hours



7. Manning Levels for the ship (Regulation 2.7)

Ordinance No. 6/ 05.04.2012 for the competency of seafarers in the Republic of Bulgaria

Chapter 3 , Part I Manning of ships, Article 13-14 stipulate minimum safe manning levels for different types of ships in different trading areas



8. Accommodation (Regulation 3.1)

Chapter 6 – Social and living conditions on the board of the ship

Articles 36 - 43 – set the standards and duties of a shipowner in relation to providing adequate accommodation.



9. On-board recreational facilities (Regulation 3.1)

Chapter 6 – Duties of the shipowner

Article 43(1) - the shipowner is obliged to insure adequate facilities and conditions for on-board recreational activities.




10. Food and catering (Regulation 3.2)

Ordinance of labour and directly connected relations between the members of a crew of a ship and the shipowner:

Chapter 6 – Duties of the shipowner

Article 37 and 38 – set the obligations of the shipowner to supply the ship with food and drinking water calculated proportionally to the number of people on board and duration of the voyage.

Article 42 prescribes the obligations for inspection of food and water supply on board.
Ordinance No. 16/1994 for the standards for healthy food of the population - sets the requires for quantity, quality of food to be supplied on board.

Order of the Executive Director of the Bulgarian Maritime Administration for the certification of cooks on board Bulgarian ships.




11. Health and safety and accident prevention (Regulation 4.3)


Ordinance of labour and directly connected relations between the members of a crew of a ship and the shipowner:

Chapter 3 – duties of the shipowner, master and crew members in regard to ensuring health and safe environment on ships

Chapter 7 – general requirements for health and safety on board of a ship

Chapter 8 – prevention of accidents while employed on board of a ship
Ordinance No. 11/ 26.04.2004 for the inspection of ships and shipowners, Annex No. 2 – compulsory health and safety equipment on board which also prevents accidents.




12. On-board medical care (Regulation 4.1)

Merchant Shipping Code (Last amended SG 28/2013 )

Article 100a requires the shipowner to provide medical care, medicines and medical equipment on board ships taking into account type of ships, number of crew, duration of the voyage and the trading area.
Ordinance No. 9 / 11.02.2003 for the medical service provided on ships. (amended in March 2006) – lays down the provisions governing the medical service, equipment and care provided on all ships sailing under Bulgarian flag excluding non-merchant, military and purely sports shipping vessels





13. On-board complaint procedures (Regulation 5.1.5)

Chapter 5 – Article 100b – after receiving a complaint from a crew member, Maritime Administration is obliged to investigate the living and working conditions, hours of work and rest on the board of a ship.

Chapter 6 – Article 45 - the shipowner has to develop and implement procedures for resolving the issues raised by complaints and reports by crew members in the shortest possible time.
